Legal Authority and Illinois TRUST Act
Illinois law enforcement agencies operate under Illinois law, including the Illinois TRUST Act. The TRUST Act bolsters community trust and cooperation by affirming that law enforcement agencies in Illinois are largely prohibited from participating in immigration enforcement activities.
- Under Illinois law:
- Illinois law enforcement does not participate in civil immigration enforcement
- Illinois law enfrocement officers do not detain indivduals for civil imigration violations
- Illinois law enforcement officers do not inquire into the citizenship or immigration status of any individual in the official's custody
- The TRUST Act does not prohibit Illinois law enforcement from:
- Being present near federal facilities
- Protecting public safety
- Managing traffic
- Facilitating lawful protest activity
- Restoring order when conduct becomes unlawful
